Head of the government could have stopped Supreme Court
   

Apex court on Thursday looked in to the charge sheet filled by the CBI and said that the Prime Minister could have stopped the culprit Raja (Then Minister for Department of Telecom, now in jail) from going ahead with his own decision on 2G which incurred heavy loss to the exchequer.


The combined bench consists of Justice Singhvi and Justice H.L. Dattu said, the Prime Minister and Finance Minister were aware of the Raja’s move on 2G spectrum allocation which could make out clearly from the letter written by Prime Minister to Raja.


In his letter prime Minister Manmohan singh asked raja to allocate the spectrum through auction but the then Minister did not listen to the head of the government and allocated spectrum services on first come first basis.


Prime minister said in his letter,” I would request you (Raja) to give urgent consideration to the issues being raised with the view to ensuring fairness and transparency and let me know the position before you take any further action in this regard.”


The bench said it is very clear from the letter that the head of the government was aware but what made him not to take any action against the concerned person.
